1. SERVICE CONDITIONS AND ACCEPTANCE
1.1. These specific contracting conditions (hereinafter, the "Specific Conditions") regulate the access to and use of the service that COOKNEST makes available to its users so that, through the COOKNEST Platform, they may personalize their own recipe book (hereinafter, the "PERSONALIZED BOOKS SERVICE"), and must be accepted by the users (hereinafter, the "Users") who wish to enjoy it.
1.2. These Conditions of the PERSONALIZED BOOKS SERVICE are complemented by the Terms of Service of the Cooknest Platform (hereinafter, the "General Conditions").
1.3. It is the User's responsibility to periodically check whether modifications or changes have been introduced in these Conditions of the PERSONALIZED BOOKS SERVICE or in the General Conditions, and to comply at all times with the terms and conditions contained therein.
2. CONTRACTUAL DOCUMENTATION AND ORDER OF PREVALENCE
2.1. In the event of any discrepancy or contradiction, the order of prevalence of the contractual documents that constitute the agreement between the User and COOKNEST is as follows:
(i) These Conditions of the PERSONALIZED BOOKS SERVICE.
(ii) The General Conditions.
2.2. These contractual documents replace any other prior agreement between the User and COOKNEST regarding the same subject matter.
3. CONTENT OF THE PERSONALIZED BOOKS SERVICE
3.1. By subscribing to the PERSONALIZED BOOKS SERVICE, the User may create their own fully personalized recipe book (hereinafter, the "PERSONALIZED BOOK").
3.2. The PERSONALIZED BOOK sent to the User will comply with what is stipulated in these Conditions and will have the quality and features that are standard in products of the same type and that the User can reasonably expect.
3.3. The quality of the printed products depends on the quality of the digital images uploaded by the User; therefore, COOKNEST cannot accept claims based on color differences between a printed version and the original digital image.
3.4. The PERSONALIZED BOOK is for the User's personal use and may not be transferred to third parties or used for any commercial purpose.
4. RIGHT OF WITHDRAWAL
4.1. Due to the nature of our services (production of personalized books), the User is informed of the loss of the right of withdrawal, insofar as the content is unique and produced according to the customization selected by the User.
5. PRICE AND PAYMENT CONDITIONS
5.1. The User undertakes to pay COOKNEST the price of the PERSONALIZED BOOKS SERVICE (hereinafter, the "Price") in full compliance with the payment conditions and other requirements established by COOKNEST at any given time (hereinafter, the "Payment Conditions").
5.2. COOKNEST shall have no obligation to provide the PERSONALIZED BOOKS SERVICE if the User has not paid the full Price or fails to comply with the Payment Conditions.
5.3. In the event that the User breaches their obligations regarding the Price, the Payment Conditions, or any other conditions set forth herein or in the General Conditions, COOKNEST reserves the right to suspend the delivery of the PERSONALIZED BOOK or to terminate the contractual relationship with the User.
6. METHOD OF DELIVERY OR EXECUTION
6.1. COOKNEST will begin printing the PERSONALIZED BOOK after the User's request and payment have been processed.
6.2. Given the nature of a personalized product, returns or cancellations of the PERSONALIZED BOOK will not be accepted.
6.3. Our intention is to begin production of the PERSONALIZED BOOK immediately after the order is finalized. Delivery times should not be considered binding deadlines or guaranteed dates, and we can only make our best efforts to deliver the products you ordered in accordance with the estimated delivery times.
6.4. If you order more than one PERSONALIZED BOOK at the same time, we may ship them together in a single package. In such cases, the longest delivery time will apply.
6.5. Orders are delivered by regular mail or through a carrier.
6.6. If the PERSONALIZED BOOK is non-conforming due to an obvious defect or an incomplete or incorrect processing of your order, please notify us within 15 days from the date you detect the lack of conformity, or within any longer period established by applicable mandatory law. Regarding the warranty, if the User qualifies as a consumer, they are entitled to a warranty for manufacturing defects that appear within the term and conditions established by applicable regulations.
6.7. In the event of a lack of conformity, you are entitled to a free repair or replacement of the PERSONALIZED BOOK, which we will attempt to send to you within our usual delivery timeframes. We will send it at no cost to you.
6.8. If COOKNEST is unable to provide the User with a repair or replacement that remedies the lack of conformity, the User will be entitled to terminate the contract and receive a full refund of the purchase price.
6.9. COOKNEST is under no obligation to provide the User with a solution for a PERSONALIZED BOOK damaged as a result of improper use by the User or normal wear and tear.
6.10. The subscription to the PERSONALIZED BOOKS SERVICE is personal and non-transferable to third parties. If abusive or non-compliant use of the service is detected, as defined in these Conditions or in the General Conditions, COOKNEST reserves the right to cancel the service and notify the User by email.
